The terms and conditions of use applicable to the Perkins Engines Company Limited online Operation and Maintenance Manuals ('OMMs') shall be the standard terms and conditions governing use of the Perkins Engines Company Limited website (www.perkins.com) in force from time to time except to the extent as varied by this notice. In the event of any conflict as between such terms the order of precedence shall be this notice followed by the standard website terms and conditions.

The online OMMs and information (including images) therein are protected by copyright law. They are provided solely for the purpose of providing Perkins Engines Company Limited direct customers and official distributors (together hereinafter referred to as 'Licensed Users') with information regarding the use and maintenance of Perkins Engines Company Limited products. Any other use of the information within the online OMMs outside this authorized purpose is not allowed and Perkins Engines Company Limited assumes no responsibility or liability for any use outside this authorized purpose.

In providing the online OMMs Perkins Engines Company Limited recognizes that Licensed Users may download and print the information contained within the online OMMs and may also incorporate this into the Licensed User's own manuals for distribution to its own customers. It is the responsibility of the Licensed User to ensure that in downloading and printing the information from the online OMMs and, where relevant, incorporating this into their own manuals they provide all the information required by law, including but without limitation to the requirements of the Machinery Directive 2006/42/EC, and any successor directives or requirements. Where the information within the online OMMs is incorporated into the Licensed User's own manual or otherwise used or distributed by the Licensed User the online OMM must be used in its entirety and without any revision or amendment by the Licensed User. The Licensed User shall indemnify Perkins Engines Company Limited for any liability whatsoever it incurs in the event that the Licensed User fails to provide any or all of the required information to its customers or other third parties.

For the avoidance of doubt provision of the online OMMs is not intended to avoid statutory or other legal obligations on Perkins Engines Company Limited to provide OMMs in hard copy format where any such obligation exists. Licensed Users selling Perkins Engines Company Limited products within any country where hard copy OMMs are required may access the online OMMs for informational purposes only.

Perkins Engines Company Limited shall not be liable to the Licensed User or any third party for any indirect or consequential loss, damage, expense or cost (including but not limited to loss of profits, contracts or production) howsoever arising out of or in connection with the use of or access to the online OMMs, and Perkins Engines Company Limited's maximum liability in any event shall be limited to the invoiced value of the Perkins Engines Company Limited products concerned.

Nothing in these conditions shall have the effect of excluding or restricting the liability of Perkins Engines Company Limited for death or personal injury resulting from Perkins Engines Company Limited's own negligence
